GOVERNMENT OF THE VIRGIN ISLANDS OF THE UNITED STATES = 0 —- DEPARTMENT OF PROPERTY AND PROCUREMENT SUPPLY CONTRACT S18NDPWT21 (RCRM) This AGREEMENT, made this ___2nd day of March | 2021 for Roadside Maintenance, Gut Cleaning, Cemetery Cleaning, and Maintenance on St. Thomas/Water Island, Virgin Islands by and between the Government of the Virgin Islands, hereinafter called the “GOVERNMENT”, and Rijo Consultant, Repairs & Maintenance, LLC whose address is P. O. Box 9003, St. Thomas, Virgin Islands 00801 hereinafter called the “CONTRACTOR”, WITNESSETH: For, and in consideration of the acceptance of the Contractor’s proposal, under Request for Proposals No. RFP-004-T-2021 (P) (A) opened on January 28, 2021, and the award of this contract to the Contractor, notification hereof having been made to the Contractor on February 23, 2021, and, in further consideration of the covenants and agreements of the Parties herein contained, to be well and truly observed and faithfully kept by them, and each of them, it is mutually agreed between the Parties as follows: SECTION 1. That for and in consideration of the price or prices and agreement in this proposal hereto attached and made a part of this Contract, the said Contractor agrees to furnish and deliver all of the services described in the said Request for Proposals No. RFP-004-T-2021 (P) (A) and the Scope of Work (Addendum ]) at the price or prices stated therein and in strict accordance with the conditions of said accepted proposal. The Advertisement, Scope of Work (Addendum I), Compensation (Addendum II), General Provisions (Addendum III), Termination of Contracts (Addendum IV), Negotiation Memorandum, any Supplemental Provisions and Specifications including any change thereof, are all part and parcel of this Contract and are by this reference, incorporated in this Contract as fully and effectively as if set forth in detail herein. SECTION 2. The Government, for and in consideration of the full and true performance of the work by the Contractor, agrees to pay the price or prices set forth in the attached Request for Proposals and as indicated in Addendum I (Scope of Work) and Addendum II (Compensation), in lawful money of the United States, and the payment shall be made at the time and in the manner set forth in the Request for Proposals, and Addendum I] (Compensation). c SI8NDPWT21 (RCRM) 1 Initials K OPCMR ADDENDUM I SCOPE OF WORK Roadside Maintenance, Gut Cleaning, Cemetery Cleaning, and Maintenance 1. GENERAL The purpose of this contract is to provide roadside maintenance services along public right- of-way, including the cutting of bush, low hanging trees that affect safe traffic operations, removal and disposal of discarded items, gut cleaning services, cemetery cleaning and maintenance services within the St. Thomas, St. John, Water Island District, U.S. Virgin Islands as directed by an authorized representative from the Department of Public Works (DPW). Contractors will be selected to provide services on a specific island; however, the Department reserves the right to utilize a contractor on a different island in the event of an emergency or as needed to maintain the roadsides. The rate of pay for work on an alternate island will be the rate selected for the specified island. 2. SERVICES The services under this contract shall be for a period of one (1) year with a renewable option for a period of one year. The Contractor shall provide all labor, transportation, small tools, equipment, supplies and materials i.e. (fuel, oil, grease, and repairs) necessary to fully operate and maintain all equipment to provide the aforementioned services on St. Thomas/St. John and Water Island. For the purposes of this contract the right-of- way (ROW) is defined as the area within fifteen (15) feet from the edge of the pavement or twenty (20) feet on a curb where traffic is heavy, or the area up to a permanent barrier such as a retaining wall whichever is less. Ifa swale or storm drain is present, this area must also be cleaned of debris. Contract bid items must include the cost of laborers, supervisors, equipment, fuel, repairs overhead, profit, insurance, and any other cost associated with the equipment and personnel. The contractor shall provide a complete crew consisting of the specified equipment, laborers and a working supervisor for the various maintenance services out lined above. The crew will consist at a minimum of the following: A. Minimum of (3) laborers B. One (1) working supervisor C.
