ORDER



WHEREAS, on August 3, 2011, the Virgin Islands Public Services Commission (hereinafter

"PSC" or "the Commission") received an application from Pungitore Energy Development, LLC

(hereinafter “Pungitore”) for certification as a cogeneration facility pursuant to the Small Power

Production and Cogeneration Act of the Virgin Islands (30 V.I.C. § 46 et seq.), and



WHEREAS, on September 27, 2011, the Commission held a Special Meeting at the Board of

Education Conference Room located at Barbel Plaza South, St. Thomas, United States Virgin

Islands; and



WHEREAS, pursuant to 30 V.I.C. § 24, the Commission after careful review and deliberation

decided to toll the time for making a final decision on Pungitore’s application for two (2) months

from the date of the September 27, 2011 Special Meeting; and



WHEREAS, the Commission decided to opened a new docket to investigate and review

Pungitore’s application for certification as a cogeneration facility; and



WHEREAS, the Commission appointed the Georgetown Consulting Group, Inc. as its

Technical Consultant to review Pungitore’s application for certification as a cogeneration

facility; and



NOW THEREFORE, it is hereby ORDERED that a new docket be opened to investigate and

review Pungitore’s application for certification as a cogeneration facility; and it is further



ORDERED that Pungitore’s application for certification as a cogeneration facility is STAYED

for two (2) months from the date of the September 27, 2011 Special Meeting; and it is finally



ORDERED, that the Georgetown Consulting Group, Inc. is APPOINTED as Technical

Consultants to review and to make recommendations to the Commission regarding Pungitore’s

application for certification as a cogeneration facility.
