GOVERNMENT OF THE UNITED STATESVIRGINISLANDS PUBLIC SERVICES COMMISSION In Re: PSC Docket No. 289 The Virgin Islands Water and Power Order No.26/2013 Authority’s Levelized Energy Adjustment Charge ORDER WHEREAS, the Public Services Commission (“PSC” or “Commission”) has a long established process for quarterly adjustments to the Levelized Energy Adjustment Charge, commonly known as the LEAC; WHEREAS, the Water and Power Authority (““WAPA” or “the Authority”) is required to file its requested rates, forecasts and supporting information forty-five days (45) prior to the requested effective date, for each quarter of the year; and WHEREAS, WAPA filed its Petition for the January —- March quarter of 2013 on November 20, 2013; and WHEREAS,The Commission’s Technical Consultant Georgetown Consulting Group (“GCG”) filed its report with the Commission on December 14, 2012; and WHEREAS, the Commission held its noticed Special Meeting on December 18, 2012; and WHEREAS, during the Special Meeting, the Authority objected to GCG’s report; and WHEREAS, the Commission adopted Orders Nos. 20/2013 and 21/2013 (dated January 3, 2013), which established the Water LEAC and the Electric LEAC, respectively, for the period of January — March 2013; and WHEREAS, on January 29, 2013, WAPA filed its Petition for Reconsideration specifically challenging Paragraphs 2, 4 and 10 of Order No. 20/2013; and WHEREAS, on February 11, 2013, GCG submitted their initial response;
