ORDER



WHEREAS, on June 27, 2013, the Virgin Islands Public Services Commission

(hereinafter “PSC” or the “Commission”) met in Regular Session at the Virgin Islands Public

Services Commission’s offices at No. 1003 Estate Ross/Barbel Plaza, Suite No. 4, St. Thomas,

Virgin Islands and Sunny Isles Professional Building, Second Floor, Suite No. 1, St. Croix

Virgin Islands; and



WHEREAS, the Commission found that its Rules and Regulations are in need of

updating and modernizing given the significant amount of time that these rules have been in

place without review; and



WHEREAS, the Commission settled the longstanding case of Justine Flashman v. The

V.I. Public Services Commission, ST-03-CV-0000501; and



WHEREAS, as part of the settlement of this case, the Commission ordered a review of

the Rules and Regulations governing telecommunications in Order No. FIND ORDER; and



WHEREAS, upon review and deliberation the Commission voted to open a docket to

update its rules and regulations, and appoint its General Counsel Attorney Tanisha Bailey-Roka

as Hearing Examiner to oversee these proceedings.



NOW THEREFORE, it is hereby ORDERED that a docket be opened to update the

Commission’s Rules and Regulations; and



It is FURTHER ORDERED that Attorney Tanisha Bailey-Roka is appointed Hearing

Examiner to oversee the proceeding for the update of the Commission’s rules and regulations.
