MEDICAID PAYMENT PARITY FOR THE TERRI- 1 TORIES. 2 (a) ELIMINATION OF FUNDING LIMITATIONS FOR 3 PUERTO RICO, THE VIRGIN ISLANDS, GUAM, THE NORTH- 4 ERN MARIANA ISLANDS, AND AMERICAN SAMOA.— 5 (1) IN GENERAL.—Section 1108 of the Social 6 Security Act (42 U.S.C. 1308) is amended— 7 (A) in subsection (f), in the matter before 8 paragraph (1), by striking ‘‘subsection (g)’’ and 9 inserting ‘‘subsections (g) and (h)’’; 10 (B) in subsection (g)(2), in the matter be- 11 fore subparagraph (A), by inserting ‘‘and sub- 12 section (h)’’ after ‘‘paragraph (3)’’; and 13 (C) by adding at the end the following new 14 subsection: 15 ‘‘(h) SUNSET OF FUNDING LIMITATIONS FOR PUER- 16 TO RICO, THE VIRGIN ISLANDS, GUAM, THE NORTHERN 17 MARIANA ISLANDS, AND AMERICAN SAMOA.—Subsections 18 (f) and (g) shall not apply to Puerto Rico, the Virgin Is- 19 lands, Guam, the Northern Mariana Islands, and Amer- 20 ican Samoa for any fiscal year after fiscal year 2009.’’. 21 (2) CONFORMING AMENDMENT.—Section 22 1903(u) of such Act (42 U.S.C. 1396c(u)) is amend- 23 ed by striking paragraph (4). 24 VerDate Nov 24 2008 04:29 Jun 04, 2009 Jkt 079200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2680.IH H2680 jbell on PROD1PC69 with BILLS 3 •HR 2680 IH (3) EFFECTIVE DATE.—The amendments made 1 by this subsection shall apply beginning with fiscal 2 year 2010. 3 (b) PARITY IN FMAP.— 4 (1) IN GENERAL.—Section 1905(b)(2) of such 5 Act (42 U.S.C. 1396d(b)(2)) is amended by insert- 6 ing after ‘‘50 per centum’’ the following: ‘‘(except 7 that, beginning with fiscal year 2012, the Federal 8 medical assistance percentage for Puerto Rico, the 9 Virgin Islands, Guam, the Northern Mariana Is- 10 lands, and American Samoa shall be the Federal 11 medical assistance percentage determined by the 12 Secretary in consultation (for the Virgin Islands, 13 Guam, the Northern Mariana Islands, and American 14 Samoa) with the Secretary of the Interior)’’. 15 (2) 2-FISCAL-YEAR TRANSITION.—Notwith- 16 standing any other provision of law, during fiscal 17 years 2010 and 2011, the Federal medical assist- 18 ance percentage established under section 1905(b) of 19 the Social Security Act (42 U.S.C. 1396d(b)) for 20 Puerto Rico, the Virgin Islands, Guam, the North- 21 ern Mariana Islands, and American Samoa shall be 22 the highest such Federal medical assistance percent- 23 age applicable to any of the 50 States or the District 24 of Columbia for the fiscal year involved, taking into 25 VerDate Nov 24 2008 04:29 Jun 04, 2009 Jkt 079200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H2680.IH H2680 jbell on PROD1PC69 with BILLS 4 •HR 2680 IH account the application of subsections (a) and (b)(1) 1 of 5001 of division B of the American Recovery and 2 Reinvestment Act of 2009 (Public Law 111–5) to 3 such States and District for calendar quarters dur- 4 ing such fiscal years for which such subsections 5 apply respectively. 6 (3) PER CAPITA INCOME DATA.— 7 (A) REPORT TO CONGRESS.—Not later 8 than October 1, 2010, the Secretary of Health 9 and Human Services shall submit to Congress 10 a report that describes the per capita income 11 data used to promulgate the Federal medical 12 assistance percentage in the territories and how 13 such data differ from the per capita income 14 data used to promulgate Federal medical assist- 15 ance percentages for the 50 States and the Dis- 16 trict of Columbia. The report should include 17 recommendations on how the Federal medical 18 assistance percentages can be calculated for the 19 territories to ensure parity with the 50 States 20 and the District of Columbia. 21 (B) APPLICATION.—Section 1101(a)(8)(B) 22 of the Social Security Act (42 U.S.C. 23 1308(a)(8)(B)) is amended— 24 VerDate Nov 24 2008 04:29 Jun 04, 2009 Jkt 079200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H2680.IH H2680 jbell on PROD1PC69 with BILLS 5 •HR 2680 IH (i) by striking ‘‘(other than Puerto 1 Rico, the Virgin Islands, and Guam)’’ and 2 inserting ‘‘(including Puerto Rico, the Vir- 3 gin Islands, Guam, the Northern Mariana 4 Islands, and American Samoa)’’; and 5 (ii) by inserting ‘‘(or, if such satisfac- 6 tory data are not available in the case of 7 the Virgin Islands, Guam, the Northern 8 Mariana Islands, or American Samoa, sat- 9 isfactory data available from the Depart- 10 ment of the Interior for the same period, 11 or if such satisfactory data are not avail- 12 able in the case of Puerto Rico, satisfac- 13 tory data available from the Government of 14 the Commonwealth of Puerto Rico for the 15 same period)’’ after ‘‘Department of Com- 16 merce’’. 17 (4) RELATION TO AMERICAN RECOVERY AND 18 REINVESTMENT ACT OF 2009.—For any period and 19 territory in which the provisions of this subsection 20 apply to a territory, the provisions of section 21 5001(b)(2) of division B of the American Recovery 22 and Reinvestment Act of 2009 (Public Law 111–5) 23 shall not apply (except as otherwise specifically pro- 24 vided in paragraph (2)). 25 VerDate Nov 24 2008 04:29 Jun 04, 2009 Jkt 079200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H2680.IH H2680 jbell on PROD1PC69 with BILLS 6 •HR 2680 IH SEC. 3. CLARIFICATION OF MEDICAID COVERAGE FOR CITI- 1 ZENS OF FREELY ASSOCIATED STATES. 2 (a) IN GENERAL.—Section 402(b)(2) of the Personal 3 Responsibility and Work Opportunity Reconciliation Act 4 of 1996 (8 U.S.C. 1612(b)(2)) is amended by adding at 5 the end the following: 6 ‘‘(G) MEDICAID EXCEPTION FOR CITIZENS 7 OF FREELY ASSOCIATED STATES.—With respect 8 to eligibility for benefits for the program de- 9 fined in paragraph (3)(C) (relating to the Med- 10 icaid program), paragraph (1) shall not apply 11 to any individual who lawfully resides in the 12 United States (including territories and posses- 13 sions of the United States) in accordance with 14 the Compacts of Free Association between the 15 Government of the United States and the Gov- 16 ernments of the Federated States of Micro- 17 nesia, the Republic of the Marshall Islands, and 18 the Republic of Palau.’’. 19 (b) CONFORMING DEFINITION OF QUALIFIED 20 ALIEN.—Section 431(b) of such Act (8 U.S.C. 1641(b)) 21 is amended— 22 (1) in paragraph (6), by striking ‘‘or’’ at the 23 end; 24 (2) in paragraph (7), by striking the period at 25 the end and inserting ‘‘; or’’; and 26 VerDate Nov 24 2008 04:29 Jun 04, 2009 Jkt 079200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\H2680.IH H2680 jbell on PROD1PC69 with BILLS 7 •HR 2680 IH (3) by adding at the end the following: 1 ‘‘(8) an individual who lawfully resides in the 2 United States (including territories and possessions 3 of the United States) in accordance with a Compact 4 of Free Association referred to in section 5 402(b)(2)(G), but only with respect to the program 6 defined in section 402(b)(3)(C) (relating to the Med- 7 icaid program).’’. 8 (c) SETTING FMAP AT 100 PERCENT.—The third 9 sentence of section 1905(b) of the Social Security Act (42 10 U.S.C. 1396d(b)) is amended by inserting before the pe- 11 riod at the end the following: ‘‘and as medical assistance 12 for individuals described in section 402(b)(2)(G) of the 13 Personal Responsibility and Work Opportunity Reconcili- 14 ation Act of 1996’’. 15 (d) EFFECTIVE DATE.—The amendments made by 16 this Act take effect on October 1, 2009, Act and apply 17 to benefits and assistance provided on or after that date. 18 Æ VerDate Nov 24 2008 04:29 Jun 04, 2009 Jkt 079200 PO 00000 Frm 00007 Fmt 6652 Sfmt 6301 E:\BILLS\H2680.IH H2680 jbell on PROD1PC69 with BILLS
