INC ORDER WHEREAS, on October 6, 2014, the Virgin Islands Public Services Commission (hereinafter “the Commission” or “PSC”) received an Application from Caribbean W2E Conversion USVI, Inc. (hereinafter “Caribbean W2E”) seeking designation as a qualifying facility in the United States Virgin Islands; and WHEREAS, on the Commission established and opened Docket 639 to consider Caribbean W2E’s October 6, 2014 Application; and WHEREAS, on December 16, 2014, Caribbean W2E filed an Application with the Commission requesting that its Application seeking designation as a qualifying facility be withdrawn, the Commission therefore ordered that the Application be withdrawn; and WHEREAS, on April 9, 2015, Caribbean W2E resubmitted their Application seeking designation as a qualifying facility in the United States Virgin Islands, which the Commission redocketed as Docket 648; and WHEREAS, on June 30, 2015, the Commission ordered that the Application for Qualifying Facility status be accepted and Caribbean W2E must report to the Commission on its progress in obtaining an interconnection agreement with the Virgin Islands Water and Power Authority (hereinafter “the Authority” or “WAPA”), and all other necessary agreements, contracts and leases within six (6) months; and WHEREAS, the Commission met with the parties during its regular meetings over the course of several months regarding the status and continued progress of the interconnection agreements between Caribbean W2E and WAPA; and WHEREAS, on July 19, 2018, the Authority filed a Petition with the Commission seeking approval of its agreements with Caribbean W2E for the purchase of electric energy for the Territory of the Virgin islands through waste to energy conversion projects; and
