Hoars :-9-1 and 2-5 p. m. PROCEEDINGS OF ‘THE COLONIAL COUNCIL FOR ST. CROIX. (Continned from yesterday’s Avis.) Ist Member for Frederiksted Town (Coulter) remarked, Mr. Chairman. If any ®nan here snhould kno>w anytning about the xorking of the Municipal Com- mittea it is the Thairman Captain Black- wood and tha Sacretary of the OCouncil. You must remember that the commis- sions in existence prior to that | .w were quite different to the commissions exist- ing today. The By Laws which governs the affairs of the Muaieipal Com mitteo were also passed and sanactionad by th= King. The lav gwes on to say that the Muniecipal Comnmittee partakes in the affairs »f the Hospitals, the Schooi:, in other words all rhe departmeit have tvo members from th2 Municinal Con- | mittee. Now we come to the Rules of | Business tor the Municipal Committee— | After the first mezating of the Council ' those members elected by the Council as | membars of the Municipal Committee, | the first thing they do is to elect their | Chairman, tnen they proceed according * to the ordinance which tne Honorable Chairman has quoted. Now then who ' is responsible for communicating to | the head of the various departments? The Chairman. He lis to instruct the Secretary: to send a communication ~to the various heads. Now cormes the vital question—Has the Muuicipal Com- mittee in ilts last election elected tne commissicns? If that has been done has it been communicated to Govern- ment? I thank you Mr. Chairman. stii Appointed Member (Lunney) re- marked: Mr. Chairman. I have acted on the Municipal Committee for some time and that mode »f procedure as quoted by Member Coulter is correct. Ist Member for Frederiksted (Coulter) remarked: Mr. Chairman. I only wish 81. &6 KRy bX X ¥ | | to state that there is not much use in | prolonging this matter; the Government | side of it is quite clear. The Honorable ' Member stares that if the commissions | are existing and wili function, he would | withdraw his ordimgnce. Government | bhave made their position clear. and one | thing left to be doneis for the Muni- | | cipal Committee to admit their fault . | | in not sending th: result of their elec | | tion to Governm:at. I see no use in | ‘ continuing this discussion any longer. § Ist Member for Chrisdznsted Coun- | try Distriet (Stakcmann) rem vked: Mr. ~ Chairman. Certain things have turned ‘ ap by whi“h Ido not care to withdraw | the bill. 1 propose that Ist discussion:be . closed. | The Chairman gav» a recess of 20 min- l utes. ; After recess the Counecil reassembled . and Government Szcretary (Timmons) | remarked: Mr. Chairman. Justa wor j about Committees and Comissions, the 1 Government may have received the ! wrong impression. Since it stands out | that the commissions are hardly in exis | tenee and not functioning the Govern: ' ment would not like any one to have ' the impression that the Government bas - failed to make the appointments, to the - contrary the Goverament is just wil- ' ling to eo-operate 'n any way. With re- . gard to remarks made by Member Sake- - man about Police Commission in St. | ' Thomas aad how we!l it is working, I | vish to ~tate that there is a Commis- 1 sion w 'rking at the present i ne. @ ‘ ist Member for “hrisiiansted Coun- | . try Distriet (Stakeminn) remarked: Mr. ) . Chairnman lam very much pleased to | . hear ihe ramarks made by tle Govern- | ! . ment Seeretary, that the Government | will b 2 pleased to work in. harmony with | . the commissions. [ aiso at the same | ( #ime, beg tkostate that the ordinance of | 1907 has not been brought to my notice | before. I am- willing to give the Chair- | | man right and take the wrong. If the | , Government will issue instructions to his | i officers that they are to work in con- | | Junction with the commissions, then I find ro reason to continue with my pro- | posal. As far asI understand ‘rom the | Government Secretary, Goverument will | | give instructions amd the Chairman | . of the Minicipal Committee will elect | tne various commissions arnd the matter | rests. | ’, Government Secretary (Timmons) re- | ' marked: Mr. Chairman. The Honora- | | ble Memberis correct in his under- | | standing. With reference to.ihs re . marks regarding the Police Regulations and the law, the Goverament is anxious | ' that the law be complied with. The | +— Honorable Member adm:ts that he wasa . member of the Committee who drafted ~ the law and that he has made a mistake, so it is right that we be genorous. Ist Member for Frederiksted Town - (Coulter) remarked: Mr. Chairman. As far as I understand the situation I think the Municipal Commiitee has the right, ace rding to Par. 63 of the Colonial Law, to eiece the commissions, conseyuentiy that matter is settled. I want to remind you that thers are going to be only one more ordinary meeting of the Council and half of the members are to retire. I think as w 2 2re so close to election, the Municipal “ommittee should wait _untll after election to elect the commissngns. The law provides that these corrmissions should mzet but once a month. Ist Member for Christia sted Tountry District (Stakemann) remarked: Mr. Chairman. As the last Speaker bas proposed that the commissions be ap- pointed after clection, [ ask that all the sanitary laws b 2 postponed until ~fter election. . Government Secretary (7immons) re- marked: Mr. Chairman. Jln reply to he last Speaker, the Government ecan- not suspend the operations of any iaw, " and therefore canno: stop proceedings for any violations of the law, One thing more, the commissions, when appoint- ed will function according to the law passed by the CUouncil. The law says ‘‘Provided, that any such Board, Commission or Committee which shall have been divested of Ad- ministrative and (or) KExecutive func- tions as herein provided may there- after act in advisory ecapacity to the Governor ete. Ist. Member tor Christiansted Coun- try District (Stakemann) remarked: Mr. Chairman. If that is so then it would be unmecessary to appoint the commis- sions. Itis a question of assisting the poor people; the heads of the depart- ments do not know the poor people; I do not see that it is right, it is against my feeling of justice towards the poor peo- ple. There is a good deal of money tha% is being spent for useless things, that money could just as woil be spent in behalf of the poor peovlie. | The Chairman would like to know if Ist. Member for Christiansted ountry District (Stakemann) would like to have the committee appointed to receive and report oa his ,bill? Membzr Stakemann: No, I wish to withdraw the bill. 4th. Appointed Member (Blackwood) remarked: Mr. Chairman. Tt seems t> me tnat if the commissions are not to function according -to ‘rules laid down there should be new rules (The Speaker read from the By-Law a paragraph wherein’ the duaties of the Committees ‘and Commissions are defined) and con- tinuing said, Those are what we are supposed to do. If the connmissions are to be appointed as advisory boards, they should have legal pawer or none at all. The Chairman would like to know if 4th Appointed Membher (Blackwoo?d) would like to take up the bill? - Member Blackwood answered no. - - The Chairman remarked: The dis- cussion is closed. :
