GOVERNMENT OF THE VIRGIN ISLANDS OF THE UNITED STATES PUBLIC SERVICES COMMISSION IN RE ) ) REFERRAL TO DEPARTMENT OF ) Order No. 3/2013 JUSTICE PURSUANT TO 30 V.LC § 39(b) +) ) ORDER WHEREAS, on September 24, 2012, the Virgin Islands Public Services Commission (hereinafter, “PSC” or the ““Commission”) met in a Special Meeting at the Virgin Islands Port Authority’s Conference Room located at the Henry E. Rohlsen Airport, St. Croix, United States Virgin Islands; and WHEREAS, the Commission received a staff report from its Accounts Maintenance Officer calculating the unpaid annual assessment fees owed by the Water and Power Authority (hereinafter “W APA” or “Authority”) and Transportation Services of St. John, Inc. (“Transportation Services”); and WHEREAS, the Commission’s staff has identified that the Authority has failed to comply with the annual assessment Order 7/2012 for the fiscal year 2012; and WHEREAS, the Commission’s staff has identified that Transportation Services has failed to comply with the annual assessment Orders 57/2010 and 7/2012 for the fiscal years 2011 and 2012; and WHEREAS, after careful deliberation and review, pursuant to 30 V.I.C. § 39(b), the Commission voted to refer this matter immediately to the Department of Justice for enforcement of these outstanding orders; and NOW THEREFORE, it is hereby ORDERED, that this matter be referred to the Department of Justice for enforcement of Commission’s Order Numbers 7/2012 and 57/2010.
