PROPERTY IN LITIGATI N, HOW AS- SESSED. Section 23.-Property in litigation to which the inunicipality is not a party shall be assessed to the person in pos- session thereof. If such property be on depcsit with any administrative, judicial or municipai offlcial it shall be assessed to such official, who shall dispose of saf- ficient quantity thereof to pay the tax- es thereon, unless the taxes thereon be paid by some person possessing, acquir- ing or claiming a right, interest or title therein, in which case as (0 the amount paid such payment shall -onstitute in f#or of such payor a prior lien on the property as against all claimants exgept the Municipality. Property . commonly reputed to belong to the Municipality shall be asses-ed in the name of the Usufructiary thereof, it sueh there be, but such assessment shall not be heid to impair the right, title or interest of the Municipality against all other pro- perty of such usufructuary. If the vwn- er or claimants of any property not lisi- ed by another person is unknown, the assessor shall value and assess that pro perty with a proper description there- of to “*Owner unknown.’’ PERSONAL PROPERTY TO WHOM AsS- SESSED. . Section 24.-All personal property with- in or without the Municipality shall be assessed to the owner thereof in the as- sessment district in which he resides on the fifteenth day of January, except that such personal proverty as goods, wares merchandise, and other stock-in-trade, machinery employed in any branch of manufacturing or business, including machines leased or operated under a stipulation providing for the paymeunt of a royalty; horses and other livestock, as all other personai property having a permanent location within any assess- meai distriect shall be assessed to the owner in the assessment district in which it is thus situated; and chat shares of banks doing business in tne Municipali- ty shall be assessed (o their owners in the Municipality where the banks are situated, as hereinafter providea.
