Resolved, That the bill from the House of Representa- tives (H.R. 4190) entitled ‘‘An Act to designate the building located at 41–42 Norre Gade in Saint Thomas, Virgin Is- lands, for the period of time during which it houses oper- ations of the United States Postal Service, as the Alvaro de Lugo Post Office’’, do pass with the following AMENDMENTS: Page 2, after line 2, insert: 1 SEC. 3. EXCLUSION OF CERTAIN POSTAL EMPLOYEES FROM 2 FEDERAL RETIREMENT PROVISIONS RELAT- 3 ING TO REEMPLOYED ANNUITANTS. 4 (a) CIVIL SERVICE RETIREMENT SYSTEM.—Section 5 8344 of title 5, United States Code, is amended by adding 6 at the end the following: 7 ‘‘(m)(1) For the purpose of this subsection— 8 2 HR 4190 EAS ‘‘(A) the term ‘postal annuitant’ means any in- 1 dividual who becomes an annuitant by reason of re- 2 tirement from the United States Postal Service; 3 ‘‘(B) the term ‘rural postmaster’ means the post- 4 master of any post office which provides regular post- 5 al services to any rural areas, communities, or small 6 towns; and 7 ‘‘(C) the term ‘rural letter carrier’ means an em- 8 ployee of the United States Postal Service occupying 9 a position the regular duties of which involve the col- 10 lection and delivery of mail on a rural route. 11 ‘‘(2)(A) Subsections (a) and (b) shall not apply to any 12 postal annuitant receiving an annuity from the Fund while 13 such annuitant is employed by the United States Postal 14 Service, on a temporary basis, as a rural postmaster or 15 rural letter carrier, subject to subparagraph (B). 16 ‘‘(B) This subsection shall not, in the case of any postal 17 annuitant, have the effect of excluding from the application 18 of subsections (a) and (b) more than— 19 ‘‘(i) 90 days of service in any calendar year; or 20 ‘‘(ii) a total of 180 days of service.’’. 21 (b) FEDERAL EMPLOYEES’ RETIREMENT SYSTEM.— 22 Section 8468 of title 5, United States Code, is amended by 23 adding at the end the following: 24 ‘‘(j)(1) For the purpose of this subsection— 25 3 HR 4190 EAS ‘‘(A) the term ‘postal annuitant’ means any in- 1 dividual who becomes an annuitant by reason of re- 2 tirement from the United States Postal Service; 3 ‘‘(B) the term ‘rural postmaster’ means the post- 4 master of any post office which provides regular post- 5 al services to any rural areas, communities, or small 6 towns; and 7 ‘‘(C) the term ‘rural letter carrier’ means an em- 8 ployee of the United States Postal Service occupying 9 a position the regular duties of which involve the col- 10 lection and delivery of mail on a rural route. 11 ‘‘(2)(A) Subsections (a) and (b) shall not apply to any 12 postal annuitant receiving an annuity from the Fund while 13 such annuitant is employed by the United States Postal 14 Service, on a temporary basis, as a rural postmaster or 15 rural letter carrier, subject to subparagraph (B). 16 ‘‘(B) This subsection shall not, in the case of any postal 17 annuitant, have the effect of excluding from the application 18 of subsections (a) and (b) more than— 19 ‘‘(i) 90 days of service in any calendar year; or 20 ‘‘(ii) a total of 180 days of service.’’. 21 (c) CLARIFICATION.—Nothing in this section shall have 22 the effect of causing any reemployed annuitant to be treated 23 as an active employee for purposes of any provision of chap- 24 ter 83 or 84 of title 5, United States Code. 25 4 HR 4190 EAS (d) APPLICABILITY.—This section and the amend- 1 ments made by this section shall apply with respect to tem- 2 porary appointments commencing on or after the date of 3 the enactment of this Act. 4 Amend the title so as to read: ‘‘An Act to designate the building located at 41–42 Norre Gade in Saint Thomas, Virgin Islands, for the period of time during which it houses operations of the United States Postal Service, as the Alvaro de Lugo Post Office; and to pro- vide that the provisions of chapters 83 and 84 of title 5, United States Code, relating to reemployed annuitants shall not apply with respect to postal retirees who are re- employed, on a temporary basis, to serve as rural letter carriers or rural postmasters.’’.
