GOVERNMENT OF THE VIRGIN ISLANDS OF THE UNITED STATES Public Services Commission Inre: The Virgin Islands Water and Power Authority ) Docket No. 660 Petition for Emergency Interim Electric Base Rate Relief ) Order No. 57/2016 ) ORDER WHEREAS, on May 13, 2016, the Virgin Islands Water and Power Authority (hereinafter “WAPA” or the “Authority”) filed a Petition for Emergency Interim Electric Base Rate Relief with the Virgin Islands Public Services Commission (hereinafter “PSC” or “Commission) seeking the granting of a cash reserve surcharge effective on bills issued on or after June |, 2016; and WHEREAS, on May 23, 2016, the Authority filed additional documents with the Commission in support of its request for an emergency cash reserve surcharge; and WHEREAS, on May 23, 2016, Trafigura Trading LLC (hereinafter “Trafigura”) filed a Petition to Intervene in the proceedings with the Commission; and WHEREAS, on May 26, 2016, WAPA filed an Opposition to Trafigura’s Petition to Intervene and Trafigura filed a Reply to WAPA’s Opposition; and WHEREAS, on May 26, 2016, the Commission held a Special Meeting in both its offices on St. Thomas and St. Croix, United States Virgin Islands; and WHEREAS, upon review and deliberation the Commission voted SUSPEND WAPA’s Petition for Emergency Interim Electric Base Rate Relief, to permit reasonable investigation and to consolidate the Petition for Emergency Interim Electric Base Rate Relief, docket 660 and the Motion to Intervene with the pending base rate cases and refer the matter to the Hearing Examiner in those matters; and NOW THEREFORE, the Commission hereby ORDERS that: 1. The Petition for Emergency Cash Reserve is SUSPENDED for the statutory period; 2. The Petition and Docket 660, including the Motion to Intervene, are consolidated with the pending base rate cases and referred to the Hearing Examiner in those matters. So Ordered.
