SEATRANS; PETITION ) FOR FORFEITURE AND FINES ) ) ORDER WHEREAS, on March 28, 2012, the Government of the Virgin Islands by and through the Virgin Islands Department of Justice (hereinafter “Department of Justice”) submitted a Petition for Forfeiture and Fines of the exclusive franchise of Aquatic Management, LLC. d/b/a V.I. SeaTrans (hereinafter “V.I. SeaTrans”) to the Virgin Islands Public Services Commission (hereinafter, “PSC” or the “Commission”); and WHEREAS, on April 30, 2012, the Commission directed in Order No. 20/2012 that a docket be established to begin the hearing process and to appoint a Hearing Examiner for the review of the Petition for Forfeiture and Fines; and WHEREAS, on May 8, 2012, the Commission voted to appoint Attorney Lorm Kleeger as Hearing Examiner to preside over the hearing process for the Petition for Forfeiture and Fines submitted by the Department of Justice; and WHEREAS, on August 16, 2012, the hearing for the Petition for Forfeiture and Fines against V.I. SeaTrans was conducted by Hearing Examiner Lorin Kleeger at the Curriculum Center's Conference Room, located at #3 V.I. Corp Property Kingshill on St. Croix, United States Virgin Islands at 10:00 a.m. WHEREAS, on September 24, 2012, the Commission received a report and recommendations from its Hearing Examiner, Lorin Kleeger; and WHEREAS, on September 24, 2012, the Commission met in a Special Meeting at the Virgin Islands Port Authority’s Conference Room located at the Henry E. Rohlsen Airport, St. Croix, United States Virgin Islands; and. WHEREAS, upon review and deliberation the Commission voted to adopt the Hearing Examiner’s Findings of Fact of the record, and the Hearing Examiner’s report.
