property owners that are not connected to the public sewer system and reside more than sixty 
feet from the system from the full payment of a user fee

Be it enacted by the Legislature of the Virgin Islands:

SECTION 1.  Title 19 Virgin Islands Code, part VI, chapter 55, section 1524 is amended

by adding the following subsection (d):

“(d) No user fees shall be charged to property owners who are not connected to 
4 
the public sewer system and reside more than sixty feet from an available public sewer 
5 
line.  Property owners who reside within sixty feet from a public sewer line but are not 
6 
connected to the public sewer system shall not be subject to the full Wastewater User 
7 
Fee.  In such cases, the Waste Management Authority or the Property Tax Division of 
8 
the Office of the Lieutenant Governor shall assess a proximity fee not to exceed fifty 
9 
dollars annually.  The Waste Management Authority shall promulgate regulations to 
10 
implement this provision, including verification procedures and waiver eligibility.”

BILL SUMMARY

This bill amends title 19 Virgin Islands Code, part VI, chapter 55, section 1524, to exempt

property owners that are not connected to the public sewer system and reside more than sixty 
14

feet from the system from the full payment of a user fee. However, the property owner can still

be assessed a proximity fee of not more than $50.00.
