Blyden Be it enacted by the Legislature of the Virgin Islands: 1 SECTION 1. Title 12A Virgin Islands Code, chapter 2, subchapter I, section 101 is 2 amended by designating the existing language as subsection (a) and inserting the following 3 subsections (b), (c) and (d): 4 “(b) No person, merchant, corporation or vendor shall impose a surcharge on a 5 consumer who chooses to use a credit card instead of cash, check or any similar means of 6 payment in any transaction that involves the sale or lease of products and services. 7 (c) Merchants may offer discounts to promote payment in cash, check or any other 8 similar method that does not involve the use of a credit card, provided that the discount is 9 offered to all potential buyers. 10 (d) For purposes of this section the term “surcharge” means any increase in the regular 11 price of a product or service imposed on the client by the merchant or lessor when using a 12 credit card as a method of payment.” 13 2 BILL SUMMARY 1 This bill prohibits the imposition of a surcharge for the use of a credit or debit card in the 2 purchase of goods or services. 3 BR25-0210/February 18, 2025/AA/Revised/February 26, 2025 4
