ORDER



WHEREAS, on October 17, 2013, the Virgin Islands Public Services Commission (hereinafter

“the Commission” or “PSC”) received an application from Telrite Corporation d/b/a Life Wireless

(hereinafter “Telrite”) requesting designation as an Eligible Telecommunications Carrier in the United

States Virgin Islands for the limited purpose of offering Lifeline service to qualified households; and



WHEREAS, on December 19, 2013, the Commission met in regular session at both its offices on

St. Thomas and St. Croix; and



WHEREAS, the Federal Communications Commission (hereinafter “FCC”) has over the past

several years expressed concern with growing costs of the Universal Service Fund, including the

provision of Lifeline services through both landline and wireless telephone services; and



WHEREAS, the FCC has taken action concerning an investigation into Telrite’s operations in

other jurisdictions, and has issued a Notice of Apparent Liability to Telrite; and



WHEREAS, the FCC’s action raised issues concerning both the continuing eligibility of Telrite

and its financial ability to meet the requirements for designation as an eligible telecommunications cartier

in the United States Virgin Islands; and



WHEREAS, Telrite still poses the right to seek review and/or reconsideration of the FCC’s

action in the issuance of the Notice of Apparent Liability; and



WHEREAS, after and deliberation and review of Telrite’s application the Commission voted to

SUSPEND Telrite’s Petition pending Telrite’s action in response to the Federal Communication

Commission’s Notice of Liability; and



NOW THEREFORE, the Commission finds and ORDERS that:



1. Telrite’s Petition is SUSPENDED pending Telrite’s action in response to the FCC’s Notice

of Liability.



2. Telrite files a report with this Commission no later than March 19, 2014.



3. IfTelrite determines not to appeal, Telrite should file a copy of the payment receipt with a

statement detailing the financial arrangements.
