AMENDMENT No. 1 OF PROFESSIONAL SERVICES CONTRACT • e OPCMR THIS AMENDMENT made as of the ______ day of _____________, 201_ in the Territory of the Virgin Islands, by and between the Government of the Virgin Islands Department of Property and Procurement, on behalf of the Department of Planning of Natural Resources (hereinafter referred to as “Government”) and RCQuinn Consulting, Inc. whose address is 104 4th St. NE., #2, Charlottesville, VA 22902-5200 (hereinafter referred to as “Contractor”). Both parties witness to being duly authorized to execute this agreement and will attest accordingly when and where necessary. WITNESSETH WHEREAS, pursuant to Contract No. PO3OPNRT2O approved by the Commissioner of Property and Procurement on March 03, 2020 (which constitute and are hereinafter referred to a the “Contract”), the Government contracted with Contractor to provide amendments to the Virgin Islands Rules and Regulation for USVI Flood Damage Prevention, Substantial Improvement and Substantial Damage procedures and provide a Quick Reference Guide for the USVI Community; and WHEREAS, the Contract expires pursuant to its terms on May 31, 2020; and WHEREAS, the parties desire to amend the Contract, to extend its term by Ninety (90) days. to change the Scope of Work in Addendum Ito include development of procedures for DPNR to make substantial improvement and substantial damage determinations requirements in accordance ‘.vith the National Floodplain Insurance Program requirements (NFIP), Federal Emergency Management Assistance (PEMA) guidance, and the provisions in the Virgin Islands Building Code and Virgin rslands Rules and Regulations, and to incorporate comments to other flood related codes effected by the Virgin Islands Rules and Regulations Updates; and WHEREAS. the amendment of the Contract pursuant to this Amendment of Professional Services Contract shall not result in an increase to the compensation originally provided for under the Contract. NOW ThEREFORE, for mutual and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties hereto agree as follows: Cooract No. Initials:’ P056PNRT20 2020 May 26th OPCMR TERMS AND CONDiTIONS 1. The Contract, is hereby amended and its term extended by Ninety (90) days by deleting all existing language contained in Paragraph 2 and replacing it with language as follows: The term of this Contract shall be from February 1, 2020 to August 29, 2020. Upon the date execution of this Contract by the Commissioner of the Department of Property and Procurement, this Contract shall become effective for the Term set out herein. 2. Paragraph No. 4 — Travel Expenses is hereby amended to delete all travel expenses. 3. Addenda I and II of the Contract are revised by deleting all terms contained therein and inserting in lieu thereof all of the terms contained in the new Addenda I and II attached hereto as Exhibit “A”. 4. This Amendment is subject to the approval of the Commissioner of the Department of Property and Procurement and to the appropriation and availability of funds. 5. Except as expressly amended in this Amendment, all terms of the Contract remain in full force and effect. 6.
