RESOLUTION OF THE BOARD OF TRUSTEES UNIVERSITY OF THE VIRGIN ISLANDS Purpose: To approve undergraduate and graduate tuition rates effective fall 2013 for St. Kitts and Nevi s students under the terms of a Memorandum of Understanding. WHEREAS, UVI is com mitted to supporting the intellectual and professional development of the workforce in the Virgin Islands and wider Caribbean as part of the University's mission; and WHEREAS, UVI and the Government of St. Kitts and Nevis (GSKN), acting also for the Clarence Fitzroy Bryant College (C FBC) have agreed to enter into a Memorandum of Understanding (MOU) which would establish areas of functional cooperation and the tuition rates to be charged to the undergraduate and graduate students from St. Kitts and Nevis including those graduating from CFBC as per the terms of the M OU; and WHEREAS, UVI is desirous of establishing parameters of functional cooperation and tuition rates for the MOU that would be directly tied to future increases in the University's tuition rates; and WHEREAS, GSKN is committed to providing twenty-five (25) scholarships and or financial assistance of not less than USD$7,500.00 annually and six (6) study leave scholarships at four fifths of annual salary annually, with a view to granting an additional five (5) study leave scholarships in the next three to five years, to St. Kitts and Nevis students to pursue undergraduate and graduate programs respectively at UVI; and WHEREAS, on J u ne 14, 2013 the Finance Committee of the Board of Trustees voted to recommend to the Board of Trustees the approval of the basis for the tuition rates. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE UNIVERSITY AS FOLLOWS: 1. Under the terms of the Memorandum of Understanding with the Govern men t of St. Kitts and Nevis, undergraduate students will be charged a tuition rate equivalent to 1.75 times that of the undergraduate resident rate of $133.00, or $ 232.75 per credit, and graduate students will be charged a tuition rate equivalent to 1.75 times of the graduate resident rate of $330.00, or $577.50 per credit, effective fall 2013. 2. Future increases in the tuition rates charged to students from St. Kitts and Nevis will be directly tied to the tuition rates charged by the University of the Virgin Islands. 3. The President and Vice President for Administration and Finance are hereby authorized to take the necessary action to implement this resolution. 4. This resolution shall become effective J u ne 15, 2013. GSKN and CFBC shall com mit to providi g dedicated classroom and office spce for U VI to establish a physical presence i n St. Kitts and Nevi for pu rposes of offering applicable cohort driven u ndergraduate and graduate degree pr 'grams for those persons who for va rious reasons are u nable to attend classes on the UVJ USV campuses. In return. UVI shall offer St. Kitts and Nevis students and non-St_ Kitts and Nevis st . ents graduating from CFBC and pursuing a degree u nder this model a tu ition rate of 1.75 times t at of the resident rates for u ndergraduate and graduate students. Students pu rsuing a grad uate egree should be admi tted to the specified graduate degree program at U VI. Prior to their attending or pa rtici pating i n any programs a nd courses offered by UVL UVI shall assist students in the pla n ni ng stages to affor , the best opportu nity to pu rsue those degrees and p rograms offered at U VI; and will advi them on programs and courses ava ila bl e at CFBC which will give them the best prepa ra tion. UVI sha ll provide professional develop , ent and consulta ncy services to the Govern ment and people of the Federa tion of St. Kitts an ( Nevis at agreed u pon costs th rough its centers and institutes. UVI and CFBC shall collaborate on proj , cts and information/knowledge transfer in areas such as but not limited to alternative energy, e trepreneu rship, conservation and fisheries, agricultu ral research, educational and psychologica resea rch pertaini ng to social issues, risk mana gem ent, disaster maMgement, faculty and stud , nt exchange, institutional and student learn ing outcom es assessmen t, a ccreditation standa rds, in . er·institutional lecture series, performi ng arts, and sports. GS K N shall provide the req u isite exem tions to UVl faculty and staff to teach cou rses, perform consulta ncies, a nd con duct joi nt resea r h with CF BC faculty and staff. This M OU shall be for a period of ten (lb) yea rs from the date of signing_ A mid·term revi ew shall be cond ucted after five years to determin what adjustments may be req uired, such adjustments to not be u n reasona bly denied . Either pa rty shall have the right to ter , inate this MOU with or without cause u pon ninety (90) days written notice to the other party speci , ing the date of termination. I f this MO U is so termi na ted, the parties shall be liable only for perfo rm nee rendered or costs incu rred, or wh i ch have been obligated, i n accordance with ch e term of this MOU prior to the effective date of termi nation. This MOU establishes a framework for olu nta ry cooperation between UVI, GS KN a.nd CFBC which is deemed by each to be in their respec ive best interests and whi ch will result in desirable outcomes for each institu ti on. Except as otherwise expressly set forth erein, no agency, partnershi p, joi nt ventu re, or employment relationshi p shall be creat or inferred by the existence or performance of this Agreement, and none of the pa rties shal have any authority to bind the others in any respect whatsoever. Nothi ng in this M OU is i nt . ded or will be construed to confer upon or to give to any thi rd party any rights or remedies by vi ue hereof. This Agreement constitutes the entire a reement between the parties hereto, and all prior understandings or com m unications, wr . ten or oral, with respect to the matters contained herein are merged herei n . UVI. GSKN a.nd CFBC each agreed tha t t ey, their designees and assigns are acting as independent contractors and not as an agent, partne , employee or jo jnt venture party of the other party to this MOU . Except as may othetwise be agreed in riting, each party shall bear thei r own expenses i n connection with all matters contem plat · d by this Agreement .
