COMMITTEE OF THE WHOLE/FLOOR BILL NO. 36-0125 Thirty-Sixth Legislature of the Virgin Islands July 23, 2025 An act amending title 3 Virgin Islands Code, chapters 25 and 27 relating to simultaneous payment of non-legislative annuities to serving members of the Legislature of the Virgin Islands PROPOSED BY: Senator Milton E. Potter, by Request of the Governor WHEREAS, retirees who return to government service, including those elected as 1 governor or lieutenant governor, are not allowed to collect both a salary and a pension under 2 Virgin Islands law; 3 WHEREAS, current law creates a special exception for members of the Legislature of 4 the Virgin Islands, allowing them to collect both a retirement annuity for past government 5 service and their legislative salary; 6 WHEREAS, this special exception for legislators is unfair to other government retirees 7 returning to service, and undermines public trust in the government retirement system; 8 WHEREAS, this practice of is fiscally irresponsible while the Government Employees 9 Retirement System is severely underfunded and the Territory faces serious financial challenges; 10 and 11 WHEREAS, repealing this special exception will bring consistency to the law, support 12 fairness and help to protect the long-term health of the public pension system; Now, Therefore, 13 2 Be it enacted by the Legislature of the Virgin Islands: 1 SECTION 1. Title 3 Virgin Islands Code is amended as follows: 2 (a) In chapter 25, section 714, by striking subsection (g) and redesignating the 3 remaining subsections accordingly; and 4 (b) In chapter 27, section 763 by striking subsection (g) and redesignating the 5 remaining subsections accordingly. 6 SECTION 2.
