Act No. 6333, Section 30 is repealed. BILL SUMMARY Section 1, subsection (a) of the bill changes the effective date of the $1 surcharge from January 1, 2000, to April 1, 2000, to correspond to the actual date of implementation of surcharge assessment and collection. Subsection (b) of Section 1 expands the list of items for which monies from the Emergency services Fund may be expended. Under existing law, the Commissioners of Health and Police and the Director of the Fire Service may purchase, among other items listed, 911 emergency equipment. Subsection (b) authorizes the expenditure for 911 emergency equipment and services. Section 2 repeals Section 30 of Act No. 6333. That section established the Youth Education and Training Endowment Fund. The Governor had line-item vetoed subsections (a) (2), which authorized the Commissioner of Education to expend monies from the Fund, and (b), which set forth the section’s effective date, leaving only subsection (a) (1), which merely established the fund. Title 12, chapter 17, Virgin Islands Code, is amended in the following instances: (a) The chapter is amended by substituting “Department of Planning and Natural Resources” for “Department of Conservation and Cultural Affairs” wherever it appears; and (b) Section 715, is amended as follows: (1) Subsection (b) is re-designated as subsection (d); and (2) At the end of subsection (2), paragraph (a), add new paragraphs (b) and (c) to read: (b) The Department may take or cause a derelict vessel to be taken into custody immediately upon its discovery. Upon taking custody of a derelict vessel the Department shall concurrently: (i) publish a notice of intended disposition once in a newspaper of general circulation; (ii) when possible, post a notice of intended disposition on the vessel; and (iii) - serve a duplicate of the notice of intended disposition by certified mail, with a return receipt, on (A) _ the registered owner of the vessel, if known, at the registered owner's last known address or the address on record with any department or the United States Coast Guard; and (B) all lien holders who have filed a financing statement indexed in the name of the registered owner, or who are shown on the records of any department or the United States Coast Guard. (c) (1) If the vessel is not repossessed within 30 days after the publication or mailing of the notice, whichever occurs later, the Commissioner may dispose of the vessel by negotiated sale; except that when two or more prospective purchasers indicate an interest in purchasing the vessel, the Commissioner shall sell the vessel at public auction to the highest bidder in the manner as prescribed by rules and regulations promulgated hereunder. (2) If no prospective purchaser indicates a desire to purchase the vessel, the vessel may be properly disposed of as junk, donated to a governmental agency, or destroyed.” SECTION 7. Title 29, chapter 14, section 915a, subsection (d) is amended in the 22 es fourth sentence by inserting after “place”, “if the business has applied for assistance”. SECTION 8. Act No. 6254, Section 1, is amended by striking: “opor. & Main. There is appropriated from the Indirect Cost Fund, established under title 33, section 3025, of the Virgin Islands Code, the sum of $1,000,000 for the fiscal year ending September 30, 2000 to the Virgin Islands Water and Power Authority for the purpose of extending, repairing and maintaining the water lines in Estates Tutu, Anna’s Retreat, and Smith Bay, St. Thomas. SECTION 10. Title 3, section 713, subsection (a), Virgin Islands Code, is amended by inserting after the word “contributions” where it first appears the words “plus four percent (4%) interest”.” SECTION 11. Title 3, section 584a, subsection (d), Virgin Islands Code, is amended by adding a comma and the following language after the words ‘correction officer’: “including any corrections officer employed by the Department of Human Services, firemen of the Virgin Islands Port Authority, probation officer of the Territorial Court.” SECTION 12. There is appropriated for the fiscal year ending September 30, 2000, or as much as may be necessary but not more than $250,000 from the Virgin islands Public Accountancy Fund as established under title 27, section 231, Virgin Islands Code, to the Legislature of the Virgin Islands for the cost of obtaining an independent consultant to provide a detailed analysis of the proposal submitted by the Governor conceming the Virgin Islands Water and Power Authority and Southern Energy. Such sum shall remain available until expended, and any remaining or unexpended funds shall be redeposited into the Public Accountancy Fund. SECTION 13. Pursuant to Title 29, chapter 3, section 238a, Virgin Islands Code, a use variance from R-4 (Residential-Medium Density) zoning designation is granted to Plot 12 Estate Profit, King Quarter, St. Croix, Virgin Islands which consists of approximately 0.222038 U.S. acres, as shown on P.W.D. Drawing No. 997, revised February 17, 1965, for the purpose of establishing a restaurant, tavern, barber shop and beauty salon. The use variance is granted subject to the following conditions: 1. The construction and development of the proposed business structure and activity shall not alter the residential context or character of the neighborhood; 2. Where the property abuts any residentially zoned lots, a buffer of fencing, trees, and/or shrubs, approximately 6’0”-7°0” high, shall be installed surrounding the property to protect and maintain the visual aesthetics and general safety of the area; 3. The applicant shall comply with the existing R-4 zoning designation, as prescribed in title 29, chapter 3, sections 229 and 230 of the Virgin Islands Code by providing adequate off-street parking and loading/unloading spaces; and 4. All other requirements of the R-4 (Residential Medium) zoning designation shall continue to apply to the subject property. SECTION 14. Title 4, chapter 27, Virgin Islands Code, is amended in the following instances: (a) Delete the section title and the first two paragraphs and insert in lieu thereof the following; “8442. The Judicial Council Imprest Account (a) Notwithstanding any other law, the Judicial Council of the Virgin Islands (the “Judicial Council”) is authorized to establish a separate operating bank account to be known as the “Judicial Council Imprest Account”. The account shall consist of all eligible federal funds, all donations, gifts and bequests, and other revenues designated to the Imprest Account. The Judicial Council and the Presiding Judge of the Territorial Court shall provide for the administration of the account and shall promulgate rules and regulations governing the expenditure of funds consistent with the provisions of this section. (b) All monies received by the Judicial Council shall be deposited into the Imprest Account, provided however, that of the $500.00 annual licensing fee required to be paid by each practicing attorney pursuant to title 27, section 302, of this Code, the sum of $200.00 shall be made payable to the Judicial Council for deposit into the Imprest Fund. The remaining $300.00 of the licensing fee shall be covered into the General Fund of the Treasury of the Government of the Virgin Islands.” (b) The third paragraph is amended by designating it as subsection (c) and deleting in the first sentence thereof the words “Law Library Fund” and inserting in lieu thereof the words “Judicial! Council Imprest Account.” SECTION 15. There is appropriated in the fiscal year ending September 30, 2000, from the General Fund Cost Center C-71061, Log Number 5014 of the Treasury of the Government of the Virgin Islands to the Virgin Islands Police Department all unexpended funds therein, $150,000 of which shall be used for ongoing maintenance at the Leander Jurgen Command in Cruz Bay, St. John, and the balance thereof for the repair and upgrading of the St. John Vehicle Inspection Lane. Title 12, chapter 17 is amended in the following instances: (a) The chapter is amended by substituting “Department of Planning and Natural Resources” for “Department of Conservation and Cultural Affairs” wherever it appears; and (b) Section 715, is amended as follows: - (1) Subsection (b) is re-designated as subsection (d); (2) At the end subsection (2), paragraph (a), subparagraphs (/) through (iii) and new subsections (b) and (c) are added to read: “The Department may take or cause a derelict vessel to be taken into custody immediately upon their discovery. Upon taking custody of a derelict vessel the - Department shall concurrently (i) publish a notice of intended disposition once in a newspaper of general circulation; (i?) when possible, post a notice of intended disposition on the vessel; and (iii) serve a duplicate of the notice of intended disposition by certified mail, with a return receipt, on | (A) the registered owner of the vessel, if known, at the registered owner's last known address or the address on record with any department or the United States Coast Guard; and (B) all lien holders who have filed a financing statement indexed in the name of the registered owner, or who are shown on the records of any department or the United States Coast Guard. , (c) (1) If the vessel is not repossessed within 30 days after the publication or mailing of the notice, whichever occurs later, the Commissioner may dispose of the vessel by negotiated sale; except that when two or moré prospective purchasers indicate an interest in purchasing the vessel, the Commissioner shall sell the vessel at public auction to the highest bidder in the manner as prescribed by rules and regulations promulgated hereunder. (2) If no prospective purchaser indicates a desire to purchase the vessel, the vessel may be properly disposed of as junk, donated to a governmental agency, or destroyed.” BILL SUMMARY This measure authorizes the Department of Planning and Natural Resources to sell or otherwise dispose of wrecked and derelict vessels. Existing law designates the Department of Planning and Natural Resources as the agency of the territory authorized to remove derelict vessels from public waters. Existing law, nonetheless, does not authorize the Government to such vessels.
