BE IT ENACTED by the Legislature of the Virgin Islands:

SECTION 1. Title 33, chapter 111, section Virgin Islands Code, as amended by Act

No. 6333 is amended in the following instances:

(a) Section 29, subsection (a) is amended by striking “January” and

inserting “April”, and by striking “within 15 days of collection”

and inserting “on a monthly basis in accordance with the billing



and collection procedures of the Virgin Islands Telephone

(b) Section 29, subsection (d), is amended in § (d) by inserting after

“O11 emergency” and before “equipment”, the words, “services and”.

SECTION 2. Act No. 6333, Section 30 is repealed.



BILL SUMMARY



Section 1, subsection (a) of the bill changes the effective date of the $1 surcharge

from January 1, 2000, to April 1, 2000, to correspond to the actual date of

implementation of surcharge assessment and collection. Subsection (b) of Section 1

expands the list of items for which monies from the Emergency services Fund may be

expended. Under existing law, the Commissioners of Health and Police and the Director

of the Fire Service may purchase, among other items listed, 911 emergency equipment.

Subsection (b) authorizes the expenditure for 911 emergency equipment and services.



Section 2 repeals Section 30 of Act No. 6333. That section established the Youth

Education and Training Endowment Fund. The Governor had line-item vetoed

subsections (a) (2), which authorized the Commissioner of Education to expend monies

from the Fund, and (b), which set forth the section’s effective date, leaving only

subsection (a) (1), which merely established the fund.

SECTION 1. Act No. 6333 (Bill No. 23-0178), section 29, is amended in the

following instances:



(a) Subsection (a) is amended by striking “January” and inserting “April”, and

by striking “within 15 days of collection” and inserting “on a monthly basis in

accordance with the billing and collection procedures of the Virgin Islands Telephone

Corporation”; and



(b) Subsection (d), is amended by inserting after “911 emergency” and before

“equipment”, the words, “services and”.

to provide free bus transportation for students of public, private and parochial schools in

the Territory, seek federal funding and provide a request for an appropriation to the

Legislature of the Virgin Islands.

SECTION 6. Title 12, chapter 17, Virgin Islands Code, is amended in the

following instances:



(a) The chapter is amended by substituting “Department of Planning and Natural

Resources” for “Department of Conservation and Cultural Affairs” wherever it appears;

and



(b) Section 715, is amended as follows:



(1) Subsection (b) is re-designated as subsection (d); and



(2) At the end of subsection (2), paragraph (a), add new paragraphs

(b) and (c) to read:



(b) The Department may take or cause a derelict vessel to be taken into custody

immediately upon its discovery. Upon taking custody of a derelict vessel the Department

shall concurrently:



(i) publish a notice of intended disposition once in a newspaper of general

circulation;



(ii) when possible, post a notice of intended disposition on the vessel; and



(iii) - serve a duplicate of the notice of intended disposition by certified



mail, with a return receipt, on



(A) _ the registered owner of the vessel, if known, at the registered owner's last

known address or the address on record with any department or the United States Coast

Guard; and



(B) all lien holders who have filed a financing statement indexed in the name

of the registered owner, or who are shown on the records of any department or the United

States Coast Guard.



(c) (1) If the vessel is not repossessed within 30 days after the publication or

mailing of the notice, whichever occurs later, the Commissioner may dispose of the

vessel by negotiated sale; except that when two or more prospective purchasers indicate

an interest in purchasing the vessel, the Commissioner shall sell the vessel at public

auction to the highest bidder in the manner as prescribed by rules and regulations

promulgated hereunder.



(2) If no prospective purchaser indicates a desire to purchase the vessel, the vessel

may be properly disposed of as junk, donated to a governmental agency, or destroyed.”



SECTION 7. Title 29, chapter 14, section 915a, subsection (d) is amended in the

fourth sentence by inserting after “place”, “if the business has applied for assistance”.

SECTION 8. Act No. 6254, Section 1, is amended by striking:

SECTION 9. There is appropriated from the Indirect Cost Fund, established

under title 33, section 3025, of the Virgin Islands Code, the sum of $1,000,000 for the

fiscal year ending September 30, 2000 to the Virgin Islands Water and Power Authority

for the purpose of extending, repairing and maintaining the water lines in Estates Tutu,

Anna’s Retreat, and Smith Bay, St. Thomas.



SECTION 10. Title 3, section 713, subsection (a), Virgin Islands Code, is

amended by inserting after the word “contributions” where it first appears the words

“plus four percent (4%) interest”.”



SECTION 11. Title 3, section 584a, subsection (d), Virgin Islands Code, is

amended by adding a comma and the following language after the words ‘correction

officer’:



“including any corrections officer employed by the Department of Human



Services, firemen of the Virgin Islands Port Authority, probation officer of the Territorial

Court.”



SECTION 12. There is appropriated for the fiscal year ending September 30,

2000, or as much as may be necessary but not more than $250,000 from the Virgin

islands Public Accountancy Fund as established under title 27, section 231, Virgin

Islands Code, to the Legislature of the Virgin Islands for the cost of obtaining an

independent consultant to provide a detailed analysis of the proposal submitted by the

Governor conceming the Virgin Islands Water and Power Authority and Southern

Energy. Such sum shall remain available until expended, and any remaining or

unexpended funds shall be redeposited into the Public Accountancy Fund.

SECTION 13. Pursuant to Title 29, chapter 3, section 238a, Virgin Islands Code,

a use variance from R-4 (Residential-Medium Density) zoning designation is granted to

Plot 12 Estate Profit, King Quarter, St. Croix, Virgin Islands which consists of

approximately 0.222038 U.S. acres, as shown on P.W.D. Drawing No. 997, revised

February 17, 1965, for the purpose of establishing a restaurant, tavern, barber shop and

beauty salon. The use variance is granted subject to the following conditions:



1. The construction and development of the proposed business structure and

activity shall not alter the residential context or character of the

neighborhood;



2. Where the property abuts any residentially zoned lots, a buffer of fencing,

trees, and/or shrubs, approximately 6’0”-7°0” high, shall be installed

surrounding the property to protect and maintain the visual aesthetics and

general safety of the area;



3. The applicant shall comply with the existing R-4 zoning designation, as

prescribed in title 29, chapter 3, sections 229 and 230 of the Virgin Islands

Code by providing adequate off-street parking and loading/unloading spaces;

and



4. All other requirements of the R-4 (Residential Medium) zoning designation

shall continue to apply to the subject property.



SECTION 14. Title 4, chapter 27, Virgin Islands Code, is amended in the

following instances:



(a) Delete the section title and the first two paragraphs and insert in lieu thereof

the following;



“8442. The Judicial Council Imprest Account



(a) Notwithstanding any other law, the Judicial Council of the Virgin Islands

(the “Judicial Council”) is authorized to establish a separate operating bank account to be

known as the “Judicial Council Imprest Account”. The account shall consist of all

eligible federal funds, all donations, gifts and bequests, and other revenues designated to

the Imprest Account. The Judicial Council and the Presiding Judge of the Territorial

Court shall provide for the administration of the account and shall promulgate rules and

regulations governing the expenditure of funds consistent with the provisions of this

section.



(b) All monies received by the Judicial Council shall be deposited into the

Imprest Account, provided however, that of the $500.00 annual licensing fee required to

be paid by each practicing attorney pursuant to title 27, section 302, of this Code, the sum

of $200.00 shall be made payable to the Judicial Council for deposit into the Imprest

Fund. The remaining $300.00 of the licensing fee shall be covered into the General Fund

of the Treasury of the Government of the Virgin Islands.”



(b) The third paragraph is amended by designating it as subsection (c) and

deleting in the first sentence thereof the words “Law Library Fund” and inserting

in lieu thereof the words “Judicial! Council Imprest Account.”



SECTION 15. There is appropriated in the fiscal year ending September 30,

2000, from the General Fund Cost Center C-71061, Log Number 5014 of the Treasury of

the Government of the Virgin Islands to the Virgin Islands Police Department all

unexpended funds therein, $150,000 of which shall be used for ongoing maintenance at

the Leander Jurgen Command in Cruz Bay, St. John, and the balance thereof for the

repair and upgrading of the St. John Vehicle Inspection Lane.

SECTION 17. Title 3, chapter 27, Virgin Islands Code, is amended in the

following instances:



(a) In section 705, subsection (d) insert “and probation officer” after

“marshall”; and



(b) Section 718, subsection (b) is amended by inserting “and probation

officer” after “marshall” “and probation officer”.

“SECTION __. There is appropriated for the fiscal year ending



September 30, 2000, as much as may be necessary but not more than $250,000

from the Virgin Islands Public Accountancy Fund as established under title 27,

section 231, Virgin Islands Code, to the Legislature of the Virgin Islands. for the

cost of obtaining an independent consultant to provide a detailed analysis of the

proposal submitted by the Governor concerning the Virgin Islands Water and

‘Power Authority and Southern Energy. Such sum shall remain available until

expended and any remaining or unexpended funds shall be deposited back into

Bill No. 23- _ is amended by adding an appropriately numbered section to

read as follows:



“SECTION __. Title 12, chapter 17 is amended in the following instances:



(a) The chapter is amended by substituting “Department of Planning and

Natural Resources” for “Department of Conservation and Cultural Affairs” wherever it

appears; and



(b) Section 715, is amended as follows: -



(1) Subsection (b) is re-designated as subsection (d);

(2) At the end subsection (2), paragraph (a), subparagraphs (/) through

(iii) and new subsections (b) and (c) are added to read:



“The Department may take or cause a derelict vessel to be taken into custody

immediately upon their discovery. Upon taking custody of a derelict vessel the -

Department shall concurrently



(i) publish a notice of intended disposition once in a newspaper of general

circulation;



(i?) when possible, post a notice of intended disposition on the vessel; and



(iii) serve a duplicate of the notice of intended disposition by certified mail, with a

return receipt, on |



(A) the registered owner of the vessel, if known, at the registered owner's

last known address or the address on record with any department or the United



States Coast Guard; and

(B) all lien holders who have filed a financing statement indexed in the

name of the registered owner, or who are shown on the records of any department

or the United States Coast Guard. ,



(c) (1) If the vessel is not repossessed within 30 days after the publication or

mailing of the notice, whichever occurs later, the Commissioner may dispose of the

vessel by negotiated sale; except that when two or moré prospective purchasers indicate

an interest in purchasing the vessel, the Commissioner shall sell the vessel at public

auction to the highest bidder in the manner as prescribed by rules and regulations

promulgated hereunder.



(2) If no prospective purchaser indicates a desire to purchase the vessel, the

vessel may be properly disposed of as junk, donated to a governmental agency, or



destroyed.”



BILL SUMMARY



This measure authorizes the Department of Planning and Natural Resources to

sell or otherwise dispose of wrecked and derelict vessels. Existing law designates the

Department of Planning and Natural Resources as the agency of the territory authorized

to remove derelict vessels from public waters. Existing law, nonetheless, does not



authorize the Government to such vessels.

EXPLANATION



The Department of Public Works has requested the reprogramming of the $70,000

appropriated from the Indirect Cost Fund. The appropriation is needed to fund territory-

wide improvements to its Engineering Division. This measure will also assist the

Department in providing training to all architect and engineering professionals and

project inspectors, thereby enhancing the professional and technical capabilities of the

Department’s engineering and management services. Moreover, it will reduce the

government’s dependence on outside contractual architectural/engineering services, and

will lead to the early identification of impediments to project completion.

following instances:



(a) Delete the section titie and the first two paragraphs and insert in lieu

thereof the following;



"$442. The Judicial Council Imprest Account



(a) Notwithstanding any other law, the Judicial Council of the Virgin

Islands (the “Judicial Council”) is authorized to establish a separate operating

bank account to be known as the “Judicial Council Imprest Account” (the “Imprest

Account”). The Account shall consist of all eligible federal funds, all donations,

gifts and bequests, and other revenues designated to the imprest Account. The

Judicial Council and the Presiding Judge of the Territorial Court shall provide for

J) the administration of the account and shall promulgate rules and regulations

governing the expenditure of funds consistent with the provisions of this section.



(b) All monies received by the Judicial Council shall be deposited into the

Imprest Account, provided however, that of the $500.00 annual licensing fee

required to be paid by each practicing attorney pursuant to title 27, section 302,

of this Code, the sum of $200.00 shall be made payable to the Judicial Council

for deposit into the Imprest Fund. The remaining $300.00 of the licensing fee

shall be covered into the General Fund of the Treasury of the Government of the

Virgin Islands.



(b) The third paragraph is amended by designating it as subsection (c)

and deleting in the first sentence thereof the words “Law Library Fund” and



inserting in lieu thereof the words Judicial Council Imprest Account.”

granted to Plot 12 Estate Profit, King Quarter, St. Croix, Virgin Islands which consists of

approximately 0.222038 U.S. acres, as shown on P. W. D. Drawing No. 997, revised



- February 17, 1965 for the purpose of establishing a restaurant, tavern, barber shop and

beauty salon. The use variance is granted subject to the following conditions:



(a) The construction and development of the proposed business structure and



activity shall not alter the residential context or character of the neighborhood;



—) (b) Where the property abuts any residentially zoned lots, a buffer of fencing,

trees, and/or shrubs, approximately 6°0"-770” high, shail be installed

surrounding the property to protect and maintain the visual aesthetics and

general safety of the area;

Petition to rezone Plot No. 12 Estate Profit, King Quarter, from R-4 (Residential Medium

Density) to B-3 (Business Scattered) in order to establish a bar and restaurant.



RINDINGS:



Acreage: Plot No. 12 Estate Profit consist of approximately 0.22038 U.S. Acres, as

more fully shown on Public Works Drawing No. 997, revised February 17, 1965.



Ownership: The owners of the record are Edwin Ortiz and Carmen Villegas as per

recorded Quit Claim Deed No. 4037/1999, dated September 10, 1999,



Present Use: There are currently several structures on the lot, one of which serves as the

main residence of Ortiz and Villegas, another serves as residence for a family member,

another serves as storage, and the last serves as an area for cooking.



Surrounding Uses: The subject lot is located in a predominantly residential area (north,

east and west) with few business activities in the general area. To the east is a vacant lot

which is being proposed for customer parking by the applicant.



Public Response: At DPNR’s February 3, 2000 public hearing, Mr. Ortiz spoke on his

and his wife’s behalf regarding the petition for the proposed rezoning. There were three

area residents present and they all expressed support for the petition. Support for the

petition was also expressed by the other petitioners for zoning amendments whose

applications were heard at the hearing. There were no verbal or written opposition to the

petition.



Analysis: Mr, Ortiz and Ms. Villegas appeared at the February 3, 2000 public hearing,

and Mr. Ortiz testified that it is their intent to operate a restaurant and tavern on the

subject lot. Occasionally the premise is utilized for fund raising activities for a baseball

team. The applicant indicated that when he purchased the property, he was under the

assumption that it was pre-existing, nonconforming since businesses had previously been

operated from the lot. When Mr. Ortiz learned the property was not grandfathered, he

then proceeded to petition for a rezoning.



In addition to the proposed uses mentioned in the petition, the applicants are also

contemplating utilizing the property for a barber shop and beauty salon. These

businesses are intended to serve area residents, employees of HOVENSA and VIALCO,

and the general public.



The subject lot is located along a very busy public road which transverses to and from the

Melvin H. Evans Highway. In DPNR’s analysis of the subject lot, it was noted that on-

site parking is limited, and only two (2) to three (3) vehicles can be accommodated on the

lot at one time. Being that the B-3 zone which has been requested requires off-street

parking, the applicant was asked to explain how this issue would be addressed. Mr. Ortiz

informed and presented supporting documentation that shows he has been granted

permission from an adjacent property owner to utilize Plot 13 Estate Profit for off-street

parking for patrons of the businesses, The applicant also indicated that he has been given

verbal approval from HOVENSA to utilize a lot across the street from his lot for

parking. DPNR requested documentation of both agreements, but to date, only the

documentation from Mr. Nasario Navarro, Sr. , owner of Plot 13 Estate Profit, has been

received.



The requested B-3 designation allows a total of one hundred and forty-three (143) uses as

a matter of right. The district was primarily established to allow single businesses which

provide convenient shopping and services for the neighborhood within which it is

located. Consequently, uses of the district range from low intensive, uses such as general

and professional offices, art galleries, and retailers, to higher intensive uses such as

automobile service stations and repair shops, and drive-through banks and restaurants.



Due to the surrounding residential character of the area, the subject lot should be

restricted from high intensity uses. The Department does not oppose the uses proposed

by the applicants. The Department, however does oppose the requested B-3 zoning

district, which permits as matter of right an extensive range of uses, several of which are

not compatible or consistent with the characteristics of the area



Conclusion: The Department concludes that a Use Variance should be granted to the

property, in order to protect the residential character of the neighborhood. In rendering

its conclusion, the Department analyzed the following facts of the application: (1) the

uses which the applicant has proposed, (2) the character of the immediate area, and (3)

the occupancy of the lot. Based on the foregoing, the Department concludes that a use

variance be granted to the property to specifically allow the restaurant, tavern, barber

shop and beauty salon.

In conjunction with the variance, the applicant would be required to meet the setback,

off-street parking, and loading and unloading requirements of the R-4 zone, as well as

provide buffering to prevent or mitigate any adverse visual impacts to adjacent residential

properties,



Recommendation: The Department of Planning and Natural Resources recommends

that Plot 12 Estate Profit, St. Croix, U.S. Virgin Islands be granted a Use Variance for



the purpose of operating a restaurant, tavern, barber shop and beauty salon with the

condition that all provisions 6F R&4 istrict retain their applicability to the property. The

SECTION 1. Title 33, chapter 111, section Virgin Islands Code, as amended by Act

No. 6333 is amended in the following instances:

(a) Section 29, subsection (a) is amended by striking “January” and

inserting “April”, and by striking “within 15 days of collection”

and inserting “on a monthly basis in accordance with the billing



and collection procedures of the Virgin Islands Telephone .

(b) Section 29, subsection (d), is amended in §  (d) bv inserting afier

“911 emergency” and before “equipment”, the words. “services and”.



SECTION 2. Act No. 6333, Section 30 is repealed.



BILL SUMMARY



Section |, subsection (a) of the bill changes the effective date of the $1 surcharge

from January 1, 2000, to April 1, 2000, to correspond to the actual date of

implementation of surcharge assessment and collection. Subsection (b) of Section 1

expands the list of items for which monies from the Emergency services Fund may be

expended. Under existing law, the Commissioners of Health and Police and the Director

of the Fire Service may purchase, among other items listed, 911 emergency equipment.

Subsection (b) authorizes the expenditure for 911 emergency equipment and services.



Section 2 repeals Section 30 of Act No. 6333. That section established the Youth

Education and Training Endowment Fund. The Governor had line-item vetoed

subsections (a) (2), which authorized the Commissioner of Education to expend monies

from the Fund, and (b), which set forth the section’s effective date, leaving only

subsection (a) (1), which merely established the fund.

(b) The third paragraph is amended by designating it as subsection (c) and

deleting i in the first sentence thereof the words “Law Library Fund” and inserting

in licu thereof the words “Judicial Council Imprest Account.”



SECTION 15, There is appropriated in the fiscal year ending September 30,

2000, from the General Fund Cost Center C-71061, Log Number 5014 of the Treasury of

the Government of the Virgin Islands to the Virgin Islands Police Department all

unexpended funds thercin, $150,000 of which shall be used for dngoing maintenanice at

the Leander Jurgen Command in Cruz Bay, St. John, and the balance thereof for the

repair and upgrading of the St. John Vehicle Inspection Lane.

(a) In section 705, subsection (d) insert “and probation officer’ after

“marshall”; and
