A BILL 
To amend the Energy Policy Act of 2005 to include Amer-
ican Samoa, Guam, the Commonwealth of the Northern 
Mariana Islands, Puerto Rico, and the Virgin Islands 
in certain efforts to reduce diesel emissions. 
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. DIESEL EMISSIONS REDUCTION.

(a) AMENDMENTS.—Subtitle G of title VII of the En-
4
ergy Policy Act of 2005 (42 U.S.C. 16131 et seq.) is 
5
amended—

any funds that are not claimed by a grantee or

loan recipient listed in subparagraph (C) for a

fiscal year may be reallocated by the Adminis-

trator among the grantees and loan recipients 
2
listed in subparagraph (C) that have claimed all 
3
funds allocated for such fiscal year. Any funds 
4
so reallocated shall be for use in accordance 
5
with this section.

‘‘(C) LIST.—For purposes of subparagraph 
7
(B), the grantees and loan recipients listed in 
8
this subparagraph are the Commonwealth of 
9
Puerto Rico, Guam, the United States Virgin 
10
Islands, American Samoa, and the Common-
11
wealth of the Northern Mariana Islands.’’.

(b) APPLICATION.—Irrespective of the date of the en-
13
actment of this Act, the amendments made by this section 
14
apply with respect to funding for fiscal year 2012 and 
15
each subsequent fiscal year.
