RESOLUTION OF THE UNIVERSITY OF THE VIRGIN ISLANDS

GRANTING NONEXCLUSIVE PERPETUAL EASEMENT



Objective: To grant to the Government of the Virgin Islands a nonexclusive

perpetual easement in order to improve the intersection of the entrance road to the St.

Croix Campus of the University of the Virgin Islands and the Queen Mary Highway.



Upon motion duly made and seconded, the following Resolution was unanimously

adopted by the Board of Trustees of the University of the Virgin Islands:



WHEREAS, the Government of the Virgin Islands desires to improve the

intersection of the entrance road to the St. Croix Campus of the University of the Virgin

Islands and the Queen Mary Highway; and



WHEREAS, these improvements will promote the safe and orderly flow of traffic

entering and exiting the University, and



WHEREAS, the improvement shall be done at the sole expense of the Government

of the Virgin Islands;



NOW THEREFORE BE IT RESOLVED THAT:



The President is hereby authorized to grant to the Government of the Virgin

Islands a nonexclusive perpetual easement in order to construct a portion of a new

roadway intersection on University property in the area, more or less, of the existing

entrance road to the St. Croix Campus of the University of the Virgin Islands and the

Queen Mary Highway, on such terms and conditions as the President, in the exercise of his

discretion, deems appropriate and which may include, but are not limited to the following

conditions:



That construction of the intersection is coordinated with University representatives

so it does not unduly interfere with the operations of the University;



That an appropriate survey be conducted and that all associated costs be borne by

the Government of the Virgin Islands;



That the Government of the Virgin Islands, at its expense, construct a plastered,

concrete block wall of specified dimensions on either side of the University’s

entrance with a sign stated “University of the Virgin Islands”;

That the Government of the Virgin Islands provide future bus service to terminate

at a bus stop on the campus;



That at the conclusion of the construction, the University’s property will be left in

a clean condition;



And, subject further to the condition that any necessary Federal approval be

obtained.



The President is authorized to execute any and all documents necessary to accomplish the

grant of the nonexclusive perpetual easement.



This Resolution shall take effect immediately.

Resolution of the Board of Trustees of the University of the Virgin Islands adopted at its

meeting on March 2, 1996, as recorded in the minutes of said meeting.
