THIS MATTER came before the Court on the Defendant’s motion, ECF No. 65, to 
strike the Plaintiff’s motion for preliminary injunction set forth at ECF No. 64.  For the reasons 
stated in the accompanying Memorandum Opinion it is 
 
ORDERED that the Defendant’s motion to strike is hereby DENIED.
