Dear Ms. Harvey:
As per our telephone conversation today, I have enclosed another copy of the site access
agreement for review by your attorney. Geraghty & Miller will be conducting a pumping test
at a nearby well during the week of May 2 through May 7, 1994. Access to your well for
water-level measurements, surveying, and possible sampling are essential components of our
investigation.
You explained that you have had some legal problems with your lessee and prefer to do
nothing until May 6, 1994, which will be one month since the lease reverted back to you.
However, you should be advised that the supply well is the property owner's, regardless of
tenancy agreements. As such, access to the supply well is at the discretion of the owner. Please
consult your attorney to confirm this. You should also be aware that site access has been given
by other property owners in the area for the purpose of the pumping test.
If you would show the access agreement to your attorney and sign all three copies of the
agreement as soon as possible, we would be very grateful. Please return two copies to Geraghty
& Miller, and retain one copy for your files. Again, please note that the testing will commence
on May 2, 1994, and an immediate response is needed.
