Dear Ms. Kwan:
I am serving as counsel for Texaco Caribbean Inc. with respect to
this matter and submit this response to Stephen D. Luf tig's June
30, 1989 letter, a copy of which is atttached for your reference.
As you are aware Texaco Caribbean Inc. has been cooperating with
your Agency with respect to this matter since August of 1987.
Without prejudice to our legal position and without admitting
liability, we are willing to continue this cooperation by
performing or participating in the performance of an
Investigatorial Program to determine the extent and rate of
contamination caused by the release of petroleum or hazardous
substances reasonably attributable to the Texaco service station
in the Tutu Wells Site Area.
To this end, we would appreciate the opportunity of meeting with
you to discuss the scope and timing of such an Investigatorial
Program as well as the terms of a mutually acceptable
Administrative Order.
