Without prejudice to our legal position and without admitting liability, we are willing to continue this cooperation by performing or participating in the performance of an Investigatorial Program to determine the extent and rate of contamination caused by the release of petroleum or hazardous substances reasonably attributable to the Texaco service station in the Tutu Wells Site Area.
