Tutu Service Station, located on Parcel Nos. 384 and 391 of Estate Anna's Retreat

It Is further requested that the date of making such Inspection shall be 
September 9. 10 or 11. 1992. The inspection will con^mence at 8:00 a.m. and will 
take approximately ten (10) hours to complete. In the event that Defendant Esso 
Virgin Islands. Inc. does not Indicate a preferred date by 5:00 p.m. AST, August 3. 
1992, Plaintiff Four Winds will Inform the Defendant of the selected date no later than 
August 10.1992.

In conformance with the stipulated order regarding inspection of real property. 
Plaintiff provides the following Information In subparagraphs corresponding to those in 
Paragraph 2 of the stipulated order: 
(a) the scope of the Investigation is 
(1) the locating and tracing, by means of plumber's snakes, dye tests, 
and/or excavation, the piping to and from the holding containment area and/or the oil-
water separator; and , 
(2) the ex))loration by means of a trench of an anomaly detected within a 
square area, measuring 40 feet per side, more specifically identified on Exhibit A, 
attached hereto. In the event that prior to the investigation. Geraghty & Miller, Inc. 
and/or Soil Tech. Inc. drill shallow monitoring well no. MW-8. the trench will be 
positioned to avoid tho well.

The purpose of (a)(1) Is to attempt to determine the location of the piping, to 
determine where the piping leaves the holding containment and/or the oil-water 
separator, to determine where the piping goes, and to determine the size and other 
physical charaderifitlcs of the piping. The purpose of (a)(2) Is to determine the 
physical characteristics of the anomaly revealed by means of the February 28.1992 
ground penetrating radar survey and corroborated by the results of the January 10, 
1992 soil gas survey. (The final report of the results of the ground-penetrating radar 
survey is attached hereto as Exhibit B. The results of the soil gas survey have 
already been produced.)

(d) (1) The nature and the format of the raw data to be collected will be In the 
form of physical measurements, recordation of visual findings, photographs, 
videotapes, drawings by U.S. Virgin Islands licensed survey personnel, field notes 
and electronic audio dictation equipment. 
(2) 
Thei nature and format of the raw data to be collected will be 
photographs, soil analysis, and laboratory analysis of the anomaly If It le determined 
that the anomaly has a physical existence. 
(e) September' 9,10 or 11,1992. 
(f) 
The Investigation Is expected to take approximately ten (10) hours, 
commencing at 6.00 h.m., and it Is not anticipated that It will cause disruption of the 
party's ordinal business at the property. 
(g) Excavation for both inspections may include, without limitation, the use of 
hand tools, a Jack hammer and/or a backhoe. The presence of oontaminates during 
the Investigation wilt^ be monitored by the use of flame-ionlzatlon detector (FID) 
equipped with organic vapor analyzer (OVA). 
(h) It is ant[ci{j>ated that th^ Investigation will requite an earth change permit 
from the Virgin Islands Department of Planning and Natural Resources and Plaintiff 
will obtain the required permit(6) and will be responsible for all costs associated with 
same. Pursuant to tr^e stipulated order, a copy of the application for permlt(s) will be 
provided to Defendant Esso Virgin Islands, Inc. and Defendant will provide the 
necessary authorizations within five (5) days of receipt of the permit application. 
The undersigned counsel certifies that at the time of such Inspection, all parties 
required by the slijaulated order will execute the hold harmless and Indemnity 
agreement. At auph time as the Inspection takes place, a certificate of insurance, 
logether with an appropriate attorney's certification, will be delivered to Defendant 
Esso Virgin lelands. mc.
