Plaintiff Hill International’s Objections to the Report and Recommendation (Dkt. No. 93) are OVERRULED; 2. The Report and Recommendation (Dkt. No. 87) is APPROVED and ADOPTED; 3. Defendant’s 12(b)(1) motion as to standing is GRANTED and Plaintiff’s procurement power claims are DISMISS WITHOUT PREJUDICE for lack of standing; 4. Defendant’s 12(b)(6) motion is GRANTED and Counts I, II, and III of Plaintiff’s Complaint are DISMISSED WITH PREJUDICE for failure to state a claim; 5. Defendant’s 12(b)(1) motion as to exhaustion is DENIED WITHOUT PREJUDICE; and 6. Defendant’s motion to dismiss under Rule 12(b)(5) for insufficient service of process is DENIED as MOOT.
