Gittens, Marvin A. Blyden and Novelle E. Francis, Jr. Be it enacted by the Legislature of the Virgin Islands: 1 SECTION 1. Title 2 Virgin Islands Code, chapter 1 is amended by adding section 13 2 that reads as follows: 3 “§ 13. (a) A person is personally liable for a fine of not less than $500 or imprisoned for 4 not more than 30 days, who in, or in connection with, any proceeding, hearing, or inquiry before 5 the Legislature of the Virgin Islands — 6 (1) swears or affirms— 7 (A) that he will truly testify, declare, depose, or certify; or 8 (B) that any testimony, declaration, deposition, certificate, affidavit, or 9 other writing subscribed by him is true; and 10 (2) willfully and knowingly testifies, declares, deposes, or certifies falsely or 11 states in his testimony, deposition, affidavit or certificate any matter to be true which he 12 knows to be false.” 13 2 (b) For any subsequent convictions, a person is personally liable for a fine of not less 1 than $1,000 but not more than $5,000 or imprisoned for not more than 60 days. 2 BILL SUMMARY 3 This bill makes it unlawful to provide false testimony under oath in proceedings before 4 the Legislature of the Virgin Islands and subjects the person to be personally liable for a fine 5 of not less than $250 or to imprisonment of not more than 30 days. 6 BR23-0333/March 3, 2023/SLR 7
