GOVERNMENT OF THE VIRGIN ISLANDS OF THE UNITED STATES PUBLIC SERVICES COMMISSION In Re: Ocean Offshore Energy, LLC PSC Docket No. 616 Application For Certification as a Qualified Order No. 47/2013 Facility ORDER WHEREAS, on April 19, 2013, the Virgin Islands Public Services Commission (hereinafter “the Commission” or “PSC”) received an application from Ocean Offshore Energy, LLC (hereinafter “Ocean Offshore”) requesting certification as a Qualified Facility; and WHEREAS, on June 24, 2013, the Commission received a report and recommendations from its technical consultants, Georgetown Consulting Group, Inc.; and WHEREAS, on June 27, 2013, the Commission held a regular meeting at both offices on St. Thomas and St. Croix; and WHEREAS, the Commission heard from witnesses, testifiers, and its technical consultants; and WHEREAS, the Commission reviewed the application and deemed it complete and in compliance with the Virgin Islands Code and the implementing regulations of the Commission; and WHEREAS, the Commission voted to approve Ocean Offshore’s application and require that no later than one year the Applicant must return and demonstrate sufficient progress towards completion of the project; and WHEREAS, the Commission decided to establish an “avoided cost” rate docket and direct staff to return with recommendations for the appointment of a hearing examiner; NOW THEREFORE, the Commission finds and orders: 1. That the application of Ocean Offshore for certification as a qualified facility be APPROVED. 2. That no later than one year the Applicant must return and demonstrate sufficient progress towards completion of the project.
