ORDER



WHEREAS, on December 10, 2007 and March 6, 2008 the Virgin Islands Public

Services Commission (hereinafter “Commission” or “PSC”) issued Order Numbers 13/2008 and

35/2008 (hereinafter “the orders”) regarding the docket specific assessments for Aquatic

Management, LLC. d/b/a V.I. SeaTrans (hereinafter V.I. SeaTrans)(see attached); and



WHEREAS, on March 10, 2008, V.I. SeaTrans’ submitted a letter to the Commission

disputing the legitimacy of both Order Numbers 13/2008 and 35/2008; and



WHEREAS, on March 30, 2012, the Commission met in Regular Session at the Port

Authority Conference Room located at the Henry Rohlsen Airport on St. Croix, United States

Virgin Islands; and



WHEREAS, upon review and deliberation the Commission voted to establish a docket to

review its governing statues and determine its jurisdiction over V.I. SeaTrans for docket specific

assessments pursuant to 30 V.I.C. § 25.



NOW THEREFORE, it is hereby ORDERED Commission establishes a separate

docket to review the Commission’s governing statues and determine the PSC’s jurisdiction over

V.I. SeaTrans for docket specific assessments pursuant to 30 V.I.C. § 25.
