AMENDMENT No. 1 OF



SUPPLY CONTRACT NO. S073BDPWC21(MSTX)



THIS AMENDMENT made as of the 19th day of__ April , 2022 in the Territory

of the Virgin Islands, by and between the Government of the Virgin Islands DEPARTMENT OF

PROPERTY AND PROCUREMENT, on behalf of the DEPARTMENT OF PUBLIC

WORKS (hereinafter referred to as “Government”) and Marco St. Croix, Inc. whose address is

P.O. Box 5678, Christiansted, VI 00823 (hereinafter referred to as “Contractor’).



WITNESSETH



WHEREAS, pursuant to Supply Contract No. S0O73BDPWC21(MSTX) approved by the

Commissioner of Property and Procurement on November 2, 2021 and (which constitute and are

hereinafter referred to as the “Contract’’), the Government contracted with Contractor to provide



Additional Emergency Territorial and Federal Roadside Clearance on the Island of St.

Croix, U.S. Virgin Islands; and



WHEREAS, the Supply Contract expires pursuant to its terms on May 31, 2022; and



WHEREAS, the parties desire to amend the Supply Contract, to extend the term of the contract

to November 30, 2022 subject to the terms and conditions set forth below to ensure uninterrupted

services during the hurricane season and natural disasters; and



WHEREAS, the parties desire to amend the Supply Contract, to add a one (1) year renewal

option, subject to the terms and conditions set forth below;



NOW THEREFORE, for mutual and valuable consideration, the undersigned contracting

parties agree to amend the Contract as follows:



TERMS AND CONDITIONS



1. The Contract, is hereby amended by deleting all existing language contained in Section III

and replacing it with language as follows:



This Contract shall commence on June 1, 2021, and shall terminate on November 30,

2022, unless mutually extended or terminated by the Parties. The Government in its sole

discretion will have the option to extend the services under this Contract for a one-year

period commencing December _1, 2022 and terminating November _30, 2023. No

alterations or variations of the terms of the proposal shall be valid or binding upon the

Government unless made in writing and approved by the Government.

This Amendment is subject to the approval of the Commissioner of Property and



Procurement and to the appropriation and availability of funds.



Except as expressly amended in this Amendment, all terms of the Supply Contract and



Amendment No. | remain in full force and effect.
