Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. DESIGNATION. 3 The building located at 41–42 Norre Gade in Saint 4 Thomas, Virgin Islands, shall, for the period of time dur- 5 ing which it houses operations of the United States Postal 6 Service, be known and designated as the ‘‘Alvaro de Lugo 7 Post Office’’. 8 2 •HR 4190 RS SEC. 2. REFERENCES. 1 Any reference in a law, map, regulation, document, 2 paper, or other record of the United States to the building 3 referred to in section 1 shall, with respect to the period 4 referred to in section 1, be deemed to be a reference to 5 the Alvaro de Lugo Post Office. 6 SEC. 3. EXCLUSION OF CERTAIN POSTAL EMPLOYEES FROM 7 FEDERAL RETIREMENT PROVISIONS RELAT- 8 ING TO REEMPLOYED ANNUITANTS. 9 (a) CIVIL SERVICE RETIREMENT SYSTEM.—Section 10 8344 of title 5, United States Code, is amended by adding 11 at the end the following: 12 ‘‘(m)(1) For the purpose of this subsection— 13 ‘‘(A) the term ‘postal annuitant’ means any in- 14 dividual who becomes an annuitant by reason of re- 15 tirement from the United States Postal Service; 16 ‘‘(B) the term ‘rural postmaster’ means the post- 17 master of any post office which provides regular post- 18 al services to any rural areas, communities, or small 19 towns; and 20 ‘‘(C) the term ‘rural letter carrier’ means an em- 21 ployee of the United States Postal Service occupying 22 a position the regular duties of which involve the col- 23 lection and delivery of mail on a rural route. 24 ‘‘(2)(A) Subsections (a) and (b) shall not apply to any 25 postal annuitant receiving an annuity from the Fund while 26 3 •HR 4190 RS such annuitant is employed by the United States Postal 1 Service, on a temporary basis, as a rural postmaster or 2 rural letter carrier, subject to subparagraph (B). 3 ‘‘(B) This subsection shall not, in the case of any postal 4 annuitant, have the effect of excluding from the application 5 of subsections (a) and (b) more than— 6 ‘‘(i) 90 days of service in any calendar year; or 7 ‘‘(ii) a total of 180 days of service.’’. 8 (b) FEDERAL EMPLOYEES’ RETIREMENT SYSTEM.— 9 Section 8468 of title 5, United States Code, is amended by 10 adding at the end the following: 11 ‘‘(j)(1) For the purpose of this subsection— 12 ‘‘(A) the term ‘postal annuitant’ means any in- 13 dividual who becomes an annuitant by reason of re- 14 tirement from the United States Postal Service; 15 ‘‘(B) the term ‘rural postmaster’ means the post- 16 master of any post office which provides regular post- 17 al services to any rural areas, communities, or small 18 towns; and 19 ‘‘(C) the term ‘rural letter carrier’ means an em- 20 ployee of the United States Postal Service occupying 21 a position the regular duties of which involve the col- 22 lection and delivery of mail on a rural route. 23 ‘‘(2)(A) Subsections (a) and (b) shall not apply to any 24 postal annuitant receiving an annuity from the Fund while 25 4 •HR 4190 RS such annuitant is employed by the United States Postal 1 Service, on a temporary basis, as a rural postmaster or 2 rural letter carrier, subject to subparagraph (B). 3 ‘‘(B) This subsection shall not, in the case of any postal 4 annuitant, have the effect of excluding from the application 5 of subsections (a) and (b) more than— 6 ‘‘(i) 90 days of service in any calendar year; or 7 ‘‘(ii) a total of 180 days of service.’’. 8 (c) CLARIFICATION.—Nothing in this section shall have 9 the effect of causing any reemployed annuitant to be treated 10 as an active employee for purposes of any provision of chap- 11 ter 83 or 84 of title 5, United States Code. 12 (d) APPLICABILITY.—This section and the amend- 13 ments made by this section shall apply with respect to tem- 14 porary appointments commencing on or after the date of 15 the enactment of this Act. 16 Amend the title so as to read: ‘‘An Act to designate the building located at 41–42 Norre Gade in Saint Thomas, Virgin Islands, for the period of time during which it houses operations of the United States Postal Service, as the Alvaro de Lugo Post Office; and to pro- vide that the provisions of chapters 83 and 84 of title 5, United States Code, relating to reemployed annuitants shall not apply with respect to postal retirees who are re- 5 •HR 4190 RS employed, on a temporary basis, to serve as rural letter carriers or rural postmasters.’’.
